We also advise clients on the protection of intellectual property. The term “intellectual property” encompasses a variety of property rights, including trademark, copyright, patents and trade secrets. A trademark is a word, phrase or logo that identifies the source of goods or services. Trademark law protects a business’ commercial identity or brand by discouraging others from adopting a name or logo that is confusingly similar to an existing trademark. Our business attorneys have extensive experience in trademark law, including new brand clearance and federal trademark protection.
A copyright protects the expression of an idea rather than the idea itself. Copyright protects original works of authorship fixed in a tangible medium including literary, dramatic, musical and artistic works. Our attorneys advise clients on protection of their works, including federal copyright registration.
Trade secrets are increasingly important in today’s business environment. In general, a trade secret is a formula, practice, commercial method or compilation of information not generally known or reasonably ascertainable by others by which a business can obtain an economic advantage over competitors or customers. At Glade Voogt Lopez Smith Felser, our attorneys also fill the role of outside general counsel for some of our clients.
